Draft Government Regulation on the Governance of Exports of Strategic Natural Resource Commodities Through State-Owned Enterprises

CHAPTER I — GENERAL PROVISIONS
Article 1
In this Government Regulation, the following terms shall have the meanings set out below:
1. Export means the activity of taking goods out of the customs area of Indonesia.
2. Strategic Natural Resource Commodity means a natural resource commodity designated by the Government having regard to the national interest, economic stability, domestic needs, and/or the management of national strategic natural resources.
3. State-Owned Enterprise, hereinafter abbreviated as BUMN, means a business entity that satisfies at least one of the following conditions:
a. all or the majority of its capital is owned by the State of the Republic of Indonesia through direct participation; or
b. special rights are held by the State of the Republic of Indonesia. 4. Export State-Owned Enterprise, hereinafter referred to as the Export BUMN, means a BUMN granted a special assignment by the Government to carry out the Export of Strategic Natural Resource Commodities.
CHAPTER II — DESIGNATION OF STRATEGIC NATURAL RESOURCE COMMODITIES
Article 2
(1) The Strategic Natural Resource Commodities subject to Export governance comprise:
a. coal;
b. palm oil; and
c. other Strategic Natural Resource Commodities.
(2) The Government may amend the Strategic Natural Resource Commodities referred to in paragraph (1) letters a and b, and may designate other Strategic Natural Resource Commodities referred to in paragraph (1) letter c, through a coordination meeting chaired by:
a. the minister responsible for the synchronization and coordination, as well as the control of the implementation, of ministerial affairs in the administration of government in the economic field; or
b. the minister responsible for the synchronization and coordination, as well as the control, of ministerial affairs in the food field,
attended by ministers/heads of non-ministerial government institutions. (3) The amendment of Strategic Natural Resource Commodities and the designation of other Strategic Natural Resource Commodities referred to in paragraph (2) shall be regulated by a regulation of the minister handling government affairs in the field of trade
CHAPTER III — EXPORT GOVERNANCE
Article 3
(1) The Strategic Natural Resource Commodities referred to in Article 2 may only be exported by the Export BUMN.
(2) The Export BUMN referred to in paragraph (1) shall be designated in accordance with the provisions of the legislation in the field of state-owned enterprises.
CHAPTER IV — GUIDANCE AND SUPERVISION
Article 4
(1) The governance of the Export of Strategic Natural Resource Commodities referred to in Article 2 may be carried out through:
a. export control; and/or
b. other mechanisms in accordance with the provisions of legislation. (2) Further provisions concerning the governance of the Export of Strategic Natural Resource Commodities referred to in paragraph (1) shall be established by each relevant minister/head of non-ministerial government institution in accordance with their respective authority.
CHAPTER V — TRANSITIONAL PROVISIONS
Article 5
Guidance and supervision over the implementation of the governance of the Export of Strategic Natural Resource Commodities shall be carried out by each relevant minister/head of non-ministerial government institution in accordance with their respective authority
Article 6
Upon the entry into force of this Government Regulation:
a. the Export of Strategic Natural Resource Commodities referred to in Article 2 may only be carried out through the Export BUMN until 31 December 2026.
b. the Export of Strategic Natural Resource Commodities referred to in Article 2, after 31 December 2026, may only be carried out by the Export BUMN.
c. in the event that the implementation of the Export of Strategic Natural Resource Commodities referred to in Article 2 has been fully transferred to the Export BUMN before 31 December 2026, the Export of Strategic Natural Resource Commodities shall be carried out in accordance with the provisions referred to in letter b
RANCANGAN PERATURAN PEMERINTAH TENTANG TATA KELOLA EKSPOR KOMODITAS SUMBER DAYA ALAM STRATEGIS MELALUI BADAN USAHA MILIK NEGARA

BAB I — KETENTUAN UMUM
Pasal 1
Dalam Peraturan Pemerintah ini yang dimaksud dengan:
- Ekspor adalah kegiatan mengeluarkan barang dari daerah pabean Indonesia.
- Komoditas Sumber Daya Alam Strategis adalah komoditas sumber daya alam yang ditetapkan Pemerintah dengan mempertimbangkan kepentingan nasional, stabilitas ekonomi, kebutuhan dalam negeri, dan/atau pengelolaan sumber daya alam strategis nasional.
- Badan Usaha Milik Negara yang selanjutnya disingkat BUMN adalah badan usaha yang memenuhi minimal salah satu ketentuan berikut:
- a. seluruh atau sebagian besar modalnya dimiliki oleh Negara Republik Indonesia melalui penyertaan langsung; atau
- b. terdapat hak istimewa yang dimiliki Negara Republik Indonesia.
- Badan Usaha Milik Negara Ekspor, yang selanjutnya disebut BUMN Ekspor adalah BUMN yang mendapatkan penugasan khusus oleh Pemerintah untuk melaksanakan kegiatan Ekspor Komoditas Sumber Daya Alam Strategis.
BAB II — PENETAPAN KOMODITAS SUMBER DAYA ALAM STRATEGIS
Pasal 2
(1) Komoditas Sumber Daya Alam Strategis yang dilakukan tata kelola Ekspor meliputi:
a. batubara;
b. kelapa sawit; dan
c. Komoditas Sumber Daya Alam Strategis lainnya.
(2) Pemerintah dapat mengubah Komoditas Sumber Daya Alam Strategis sebagaimana dimaksud pada ayat (1) huruf a dan huruf b serta menetapkan Komoditas Sumber Daya Alam Strategis lainnya sebagaimana dimaksud pada ayat (1) huruf c melalui rapat koordinasi yang dipimpin oleh:
a. menteri yang menyelenggarakan sinkronisasi dan koordinasi serta pengendalian pelaksanaan urusan kementerian dalam penyelenggaraan pemerintahan di bidang perekonomian; atau
b. menteri yang menyelenggarakan sinkronisasi dan koordinasi serta pengendalian urusan kementerian di bidang pangan,
yang dihadiri menteri/kepala lembaga pemerintah nonkementerian.
(3) Penetapan perubahan Komoditas Sumber Daya Alam Strategis dan penetapan Komoditas Sumber Daya Alam Strategis lainnya sebagaimana dimaksud pada ayat (2) diatur dalam peraturan menteri yang menangani urusan pemerintahan di bidang perdagangan.
BAB III — TATA KELOLA EKSPOR
Pasal 3
(1) Komoditas Sumber Daya Alam Strategis sebagaimana dimaksud dalam Pasal 2 hanya dapat diekspor oleh BUMN Ekspor.
(2) BUMN Ekspor sebagaimana dimaksud pada ayat (1) ditetapkan sesuai dengan ketentuan peraturan perundang-undangan di bidang BUMN.
Pasal 4
(1) Tata kelola Ekspor Komoditas Sumber Daya Alam Strategis sebagaimana dimaksud dalam Pasal 2 dapat dilakukan melalui:
a. pengendalian Ekspor; dan/atau
b. mekanisme lain sesuai dengan ketentuan peraturan perundang-undangan.
(2) Ketentuan lebih lanjut mengenai tata kelola Ekspor Komoditas Sumber Daya Alam Strategis sebagaimana dimaksud pada ayat (1) ditetapkan oleh masing-masing menteri/kepala lembaga pemerintah non-kementerian terkait sesuai dengan kewenangannya.
BAB IV — PEMBINAAN DAN PENGAWASAN
Pasal 5
Pembinaan dan pengawasan terhadap pelaksanaan tata kelola Ekspor Komoditas Sumber Daya Alam Strategis dilakukan oleh masing-masing menteri/kepala lembaga pemerintah non-kementerian terkait sesuai dengan kewenangannya.
BAB V — KETENTUAN PERALIHAN
Pasal 6
Pada saat Peraturan Pemerintah ini mulai berlaku:
a. Ekspor Komoditas Sumber Daya Alam Strategis sebagaimana dimaksud dalam Pasal 2 hanya dapat dilakukan melalui BUMN Ekspor sampai dengan tanggal 31 Desember 2026.
b. Ekspor Komoditas Sumber Daya Alam Strategis sebagaimana dimaksud dalam Pasal 2 setelah tanggal 31 Desember 2026, hanya dapat dilakukan oleh BUMN Ekspor.
c. Dalam hal pelaksanaan Ekspor Komoditas Sumber Daya Alam Strategis sebagaimana dimaksud dalam Pasal 2 sudah dialihkan sepenuhnya kepada BUMN Ekspor sebelum tanggal 31 Desember 2026, Ekspor Komoditas Sumber Daya Alam Strategis dilaksanakan sesuai dengan ketentuan sebagaimana dimaksud dalam huruf b.
